Terms of use

These terms are a contract between you and Uptrail ("we", "us") covering your use of the Etta app and service. By creating an account or using Etta, you agree to them.

1. Etta is an AI

Etta is an artificial-intelligence companion. She is not a real person, and the service will never tell your parent otherwise — she introduces herself as an AI on the very first call, and every summary in the app is labeled as AI-generated. Etta's conversation, recaps, mood trends, and alerts are AI-generated observations, not professional assessments: they can be wrong, incomplete, or miss something important, and they are not medical advice, diagnosis, monitoring, or care.

2. Etta is not an emergency service

Etta does not provide emergency response, medical alerts, fall detection, or 24/7 monitoring, and cannot call emergency services. A missed-call alert or concern flag is information for you to act on — it is not a guarantee that someone is safe, and no alert (or absence of one) should ever be relied on in place of doctors, caregivers, emergency services, or your own judgment. If you believe someone is in danger, call your local emergency number immediately.

3. Who can use Etta

You must be at least 18 years old (or the age of majority where you live) to hold an account, created through Sign in with Apple. You may hold one account.

Don't use Etta to break the law, harm anyone, or attempt to harm the service. Specifically, you agree not to:

We may suspend or terminate accounts that violate these terms, with notice where practical.

7. Your content and your parent's words

Your parent's words belong to your family. You grant us the limited license needed to process call transcripts and generate recaps, trends, and alerts — as described in our privacy policy. Recaps and other generated content are for your personal, family use.

8. Disclaimers

Etta is provided "as is" and "as available". We don't guarantee the service will be uninterrupted or error-free, that any particular call will connect or be answered, or that recaps and alerts will catch everything that matters. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms excludes rights you have under consumer law that cannot be excluded — including any statutory guarantees under the Australian Consumer Law.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, special, or consequential damages.

10. Ending things

You can stop using Etta and delete your account at any time in the app (You tab → Delete account); deletion removes your family's data as described in the privacy policy. Your parent can end the calls at any time by telling Etta to stop. We may suspend or terminate the service or your account for breach of these terms, or discontinue the service with reasonable notice.

11. Changes to these terms

We may update these terms; the effective date above will change and material updates will be flagged in the app before they take effect. Continuing to use Etta after changes take effect means you accept them.

12. Governing law

These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the non-exclusive jurisdiction of its courts — without limiting any mandatory consumer protections in your country of residence.
