Terms of use
These terms are a contract between you and Mitaanshu Agarwal, the individual who operates Etta under the Keenshift brand ("Keenshift", "we", "us"), covering your use of the Etta app and service. By creating an account or using Etta, you agree to them.
1. Etta is an AI
Etta is an artificial-intelligence companion. She is not a real person: the recipient permission page says so before any call, Etta identifies herself as AI on every call, and every summary in the app is labeled as AI-generated. Etta's conversation, recaps, mood trends, and alerts are AI-generated observations, not professional assessments: they can be wrong, incomplete, or miss something important, and they are not medical advice, diagnosis, monitoring, or care.
2. Etta is not an emergency service
Etta does not provide emergency response, medical alerts, fall detection, or 24/7 monitoring, and cannot call emergency services. A missed-call alert or concern flag is information for you to act on — it is not a guarantee that someone is safe, and no alert (or absence of one) should ever be relied on in place of doctors, caregivers, emergency services, or your own judgment. If you believe someone is in danger, call your local emergency number immediately.
3. Who can use Etta
You must be at least 18 years old (or the age of majority where you live) to hold an account, created through Sign in with Apple. You may hold one account.
4. Check-in calls and consent
- Etta places calls only to the one number you set up for your parent (or another adult loved one), using supported mobile or landline ranges in the US, Canada, or Australia. Premium-rate, toll-free, service, territory, and a small number of unusually high-cost area codes are not supported. You confirm you have a genuine family or caregiving relationship with that person and may share the permission link with them.
- No outbound call happens until the recipient opens a secure, single-use link tied to the saved number, reads the disclosures, and personally grants permission. You cannot accept for them. If they decline, withdraw permission, or the phone number changes, calls remain stopped until the recipient completes a new link and grants permission again.
- You agree not to use Etta to contact anyone without their welcome, to harass, monitor, or control another person, or to call numbers you have no right to involve.
- If you record a greeting clip, it must be your own voice, identifying yourself truthfully.
5. Subscriptions and billing
- Etta is free to download, and creating and sharing the recipient's permission link is free.
- Care ($19.99/month, or $199.99/year on the annual plan) includes a daily check-in call, recaps, concern flags, and 90 supported US/Canada or 48 Australia call minutes per month. Care+ ($34.99/month) includes morning and evening calls, 200 supported US/Canada or 100 Australia call minutes per month, and Ask Etta. The allowance follows the country of the number Etta calls. A small number of premium, service, territory, and unusually high-cost area codes are not supported; the app validates the number before setup. Prices are in USD and may vary by region.
- The purchase screen shows your local price before you buy. Subscriptions are billed through your Apple account and auto-renew each billing period (monthly, or yearly on the annual plan) until canceled. Cancel any time in your App Store subscription settings at least 24 hours before renewal. You keep access until the end of the paid period.
- Unused call minutes do not roll over. Generous fair-use limits apply to Ask Etta.
- Payments, refunds, and billing disputes are handled by Apple under their terms. Use of the app is also governed by Apple's standard Licensed Application End User License Agreement (EULA).
6. Acceptable use
Don't use Etta to break the law, harm anyone, or attempt to harm the service. Specifically, you agree not to:
- use the service for any unlawful purpose, including unlawful surveillance or harassment;
- set up calls to a person who hasn't consented, has revoked consent, or whom you have no genuine relationship with;
- misrepresent who you are, or who Etta is, to the person receiving calls;
- probe, overload, disrupt, or reverse-engineer the service, or attempt to extract its underlying models or prompts;
- resell, scrape, or automate access to the service;
- misrepresent Etta's AI-generated summaries as a professional's assessment.
We may suspend or terminate accounts that violate these terms, with notice where practical.
7. Your content and your parent's words
Your parent's words belong to your family. You grant us the limited license needed to process call transcripts and generate recaps, trends, and alerts — as described in our privacy policy. Recaps and other generated content are for your personal, family use.
8. Disclaimers
Etta is provided "as is" and "as available". We don't guarantee the service will be uninterrupted or error-free, that any particular call will connect or be answered, or that recaps and alerts will catch everything that matters. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms excludes rights you have under consumer law that cannot be excluded — including any statutory guarantees under the Australian Consumer Law.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, special, or consequential damages.
10. Ending things
You can stop using Etta and delete your account at any time in the app (You tab → Delete account); deletion removes your family's data as described in the privacy policy. Deleting your Etta account does not cancel an App Store subscription, so manage or cancel it with Apple first if you do not want future billing. Your parent can end the calls at any time by telling Etta to stop. We may suspend or terminate the service or your account for breach of these terms, or discontinue the service with reasonable notice.
11. Changes to these terms
We may update these terms; the effective date above will change and material updates will be flagged in the app before they take effect. Continuing to use Etta after changes take effect means you accept them.
12. Governing law
These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the non-exclusive jurisdiction of its courts — without limiting any mandatory consumer protections in your country of residence.
